Terms and Conditions of Sale

PREAMBLE

Any reservation made with ELITE EVASION constitutes unconditional acceptance of these terms and conditions of sale.

The term “client” refers to any individual or entity using the services of ELITE EVASION.

The driver performing the service is committed to ensuring compliance with these terms and conditions of sale and may decide to temporarily exclude any client who breaches these terms, depending on the severity of the violation. In such cases, no refund or compensation will be due.

ARTICLE 1 – RESERVATIONS

All services provided by ELITE EVASION must be reserved in advance and confirmed in writing (via email, SMS, or confirmation of the booking voucher on site). Reservations can be made by the client or an authorized representative.

Reservations can be made on the website www.elite-evasion.fr, by phone, or by email.

All reservations must include the following information:

  • The name and contact details of the individual or entity for whom the transport is performed,
  • The number of passengers,
  • The date and time of pick-up,
  • The pick-up location,
  • The drop-off location,
  • The date and time of the reservation,
  • The price of the service and the amount of the deposit paid,
  • The number of bags and their size,
  • Duration of the service for rentals.

Any specific requirements (animals, special luggage, child seats, etc.) must be specified at the time of booking; otherwise, ELITE EVASION may not honor the service.

This information will be included on the Booking Voucher, which serves as a transport contract between the client and ELITE EVASION, presented to the client upon pick-up and signed by them.

Pets must be kept on a leash or in a cage, and their presence must be specified at the time of booking.

The quantity and size of luggage must be specified at the time of booking. Otherwise, ELITE EVASION reserves the right to refuse all or part of the luggage or to perform the service (the volume of transported luggage must be proportional to the vehicle’s capacity).

Each piece of luggage must not exceed 35 kg per passenger and must not pose a risk of damage to the vehicle.

The reservation will only be validated upon payment of a deposit of at least 50% of the total service amount. To ensure the availability of ELITE EVASION drivers, reservations should, whenever possible, be made at least 24 hours in advance. For rental services, long-distance trips, or other specific services, a reservation period of 48 hours in advance is required.

ELITE EVASION reserves the right to refuse a reservation if vehicles are unavailable.

ARTICLE 2 – SERVICE

The service is valid only once.

The service begins on the day and time agreed upon between the client and ELITE EVASION, and from the location provided by the client. It ends on the day and time the vehicle returns to its departure point.

In case of delay or absence of the client at the agreed pick-up location, the driver will wait for 15 minutes. After this period, ELITE EVASION will consider the service canceled, and it will be billed to the client without any refund.

Included in the service:

  • The vehicle provided to the client,
  • The provision of a driver who speaks at least French,
  • Professional insurance for passengers transported for a fee, mileage, vehicle maintenance, fuel, and the duration specified at the time of booking,
  • Transportation of the client’s luggage within the vehicle’s capacity,
  • Toll costs.

Not included in the service:

  • Parking and stationing fees,
  • Entrance fees to sites (museums, theaters, stadiums…),
  • Entrance fees to public places.

ELITE EVASION reserves the right to refuse any service it deems unfeasible for any reason.

For multi-day trips, the following flat rates will be billed to the client:

  • Meal allowance of €25.00 per day (including VAT),
  • Hotel + breakfast allowance of €120.00 per day (including VAT).

ARTICLE 3 – MODIFICATION DURING THE SERVICE

Any modification of the route during the service by the client may incur additional charges, which will be billed to them.

These requests, modifying the Booking Voucher, may or may not be accommodated by the driver.

For rentals, any hour commenced is due, and any additional hour to the agreed package will be billed at the current rate.

For transfers, any extra mileage beyond the agreed package will be billed at the current rate.

ARTICLE 4 – CANCELLATION

Any cancellation of the service, occurring between the reservation and 48 hours before the service, will incur a charge of 50% of the total service amount. Any cancellation of the service, occurring within 48 hours and up to the time of pick-up, will incur a charge of 100% of the total service amount. Beyond a 30-minute waiting period, or in case of the client’s absence at the pick-up location without response by phone, the driver is authorized to terminate the service, even if it is not executed.

ARTICLE 5 – SERVICE CONDITIONS

The driver is authorized to objectively refuse access to the vehicle to a client whose behavior poses a clear risk of public order disturbance (drunkenness, aggressiveness, various forms of violence…) or is likely to inconvenience other users (lack of hygiene…).

If the client exhibits any of these behaviors during the trip, the driver may require them to leave the vehicle (minor passengers displaying such behavior will be taken to the nearest police station).

The driver reserves the right to refuse any instructions or requests from the client that they deem to compromise the safety of the vehicle’s occupants and other road users.

The client must:

  • Travel seated,
  • Always wear a seatbelt (article R 412-1 of the Highway Code) at the front and rear of the vehicle,
  • Respect the service conditions set by ELITE EVASION.

In our vehicles, it is prohibited to:

  • Smoke (decree no. 92-478 of May 29, 1992),
  • Put feet on the seats,
  • Soil or damage the equipment, throw trash out the windows,
  • Travel with flammable, toxic, dangerous, or foul-smelling objects,
  • Distract the driver or interfere with their driving without compelling reason,
  • Engage in any behavior that disturbs traffic and other road users,
  • Operate emergency exits or any door opening/closing mechanism except in case of an accident,
  • Move around in the vehicle during the trip (article 223-1 of the Penal Code),
  • Use lighters, matches, knives, scissors, or any object that could endanger health and safety (article 223-1 of the Penal Code),
  • Disturb the tranquility of travelers,
  • Require the driver to exceed speed limits or commit traffic violations.

ELITE EVASION reserves the right to interrupt the service if the client commits an infraction or if the client’s behavior endangers the driver or others.

Respect and proper use of equipment are mandatory. Any damage to equipment or harm caused inside the vehicle will be charged to the client.

Damage and other acts of vandalism and incivility will be subject to legal action with claims for repairs or compensation.

The driver is solely responsible for opening and closing the trunk to load and unload its contents. They ensure the safety of travelers from pick-up to drop-off.

ELITE EVASION acknowledges the obligation to take necessary measures to preserve the safety of the vehicle’s occupants.

ELITE EVASION prohibits any dangerous, toxic, offensive, or illegal materials on board the vehicles, even in luggage.

Luggage or any other belongings of the client are their sole responsibility.

ARTICLE 6 – LIMITS OF LIABILITY

ELITE EVASION cannot be held responsible for damage, loss, or theft of luggage or its contents.

ELITE EVASION cannot be held liable for delays due to traffic conditions beyond its control (roadblocks, bridge closures, traffic jams, road flooding, demonstrations, weather conditions, police, fire, or customs interventions, etc.).

ELITE EVASION cannot be held responsible for delays resulting directly from the client’s initial delay or the need to perform a route requested by the client within an evidently too short timeframe.

In case of vehicle immobilization due to mechanical failure, accident, or damage, ELITE EVASION will strive to ensure the continuity of the trip with another vehicle or a vehicle chartered from another company.

ARTICLE 7 – INSURANCE

ELITE EVASION’s liability is limited to the clauses of its insurance contract and its professional insurance “subscribed for the transport of passengers for a fee.”

ARTICLE 8 – PERSONAL DATA

ELITE EVASION is committed to respecting the privacy of its clients, and the information collected from them will not be transmitted to third parties, in accordance with French law on Data Processing, Data Files, and Individual Liberties No. 78-17 of January 6, 1978.

Rights of access and rectification can be exercised with the company’s headquarters, ELITE EVASION.

ARTICLE 9 – COMPLAINTS AND DISPUTES

Any complaint must be addressed to Mr. Florian CIABRINI, president of ELITE EVASION, by registered letter with acknowledgment of receipt to the headquarters’ address: 37 Chemin des Hirondelles – 13330 PELISSANNE, within a maximum of 5 days / 120 hours after the service execution.

After this period, only the Commercial Court of Salon-de-Provence will be competent.
